Terms of Service

When you use The Laser Workshop products or services, you are agreeing to these Terms of Service. Violation of these terms may, at our discretion, result in us terminating your account.

Definitions

  • "Company", "we", "our", or "us" refers to The Laser Workshop.
  • "Services" refers to our websites (thelaserworkshop.com), web applications, mobile applications (iOS/Android), and any product created and maintained by The Laser Workshop.
  • "You" or "your" refers to the people or organizations that own an account with one or more of our Services.

Account Terms

  • You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You are responsible for all content posted to and activity that occurs under your account.
  • You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
  • You must be 13 years or older to use this Service.
  • One person or legal entity may not maintain more than one free account.

User Contributions & Safety

The Laser Workshop allows users to share material settings, project files, and other data. By posting User Contributions:

  • Safety Warning: You acknowledge that laser cutting involves inherent risks including fire, toxic fumes, and equipment damage. Settings vary by machine, wattage, and condition. You agree that any settings you find on the Service are starting points only, and you must verify them safely on your own equipment.
  • No Liability: The Laser Workshop is not liable for any damage to your equipment, property, or person resulting from the use of settings or files found on the Service.
  • Ownership: You retain ownership of your User Contributions. However, by posting, you grant The Laser Workshop a worldwide, non-exclusive, royalty-free license to use, display, copy, and distribute these contributions on the Service.
  • Prohibited Content: You may not share settings for hazardous materials (PVC/Vinyl) without clear safety warnings. You may not upload copyrighted content, malicious files, or illegal content.

Community & Networking

The Maker Map and other community features are provided for informational and networking purposes only.

  • Offline Interactions: The Laser Workshop does not vet or background check users. Any offline interactions, meetings, or business transactions between users are at your own risk. We are not responsible for any disputes or damages arising from such interactions.
  • Accuracy of Listings: We do not guarantee the accuracy of any user-posted location or machine listing. Services and rates listed by makers are their own, and all business agreements are between the respective users.
  • Conduct: Harassment, hate speech, spam, or abusive behavior will result in immediate account termination.

Payment, Refunds, and Subscriptions

  • Free Tier: If you are using a free version of our Services, it is really free: we do not ask you for your credit card.
  • Paid Subscriptions: For paid Services, you need to pay in advance to keep using the Service. If you do not pay, we will freeze your account and it will be inaccessible until you make payment.
  • Subscription Management: We use RevenueCat to manage subscriptions across web, iOS, and Android platforms. By subscribing, you agree to RevenueCat's Terms of Service.
  • Payment Processors: Payments are processed by Stripe (web), Apple (iOS), or Google (Android). Your payment information is subject to their respective terms and privacy policies.
  • Billing Cycles: Subscriptions auto-renew monthly or annually unless canceled. You can cancel anytime from your account settings.
  • Taxes: All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, levies, or duties.
  • Refunds: Refunds are processed at our sole discretion. If you believe you were charged in error, contact support@thelaserworkshop.com within 30 days.
  • Price Changes: We reserve the right to change our pricing. We will notify you 30 days in advance of any price changes to your subscription.

Mobile Applications (iOS & Android)

If you access our Services via mobile application:

  • You agree to Apple's Standard EULA (iOS) or Google's Terms of Service (Android).
  • In-app purchases are processed by Apple or Google and subject to their refund policies.
  • We are not responsible for any issues related to app store availability, device compatibility, or operating system updates.

Affiliate Program

  • Participation: Acceptance into the Affiliate Program is at our sole discretion. We reserve the right to revoke affiliate status for any potential misuse or brand misalignment.
  • Commissions: Commissions are calculated based on net revenue from referrals. Commission rates vary by plan and are shown in your Affiliate Dashboard. We track commissions for 12 months from the referral date.
  • Cross-Platform Tracking: We use RevenueCat to track affiliate referrals across web, iOS, and Android. Commissions are calculated on all subscription revenue generated by your referrals regardless of platform.
  • Payouts: Payouts are processed via PayPal once your balance reaches the minimum threshold ($25.00 default). Payouts are processed monthly within 30 days of month-end.
  • Taxes: You are responsible for reporting and paying any taxes on your affiliate earnings as required by your local jurisdiction.
  • Prohibited Practices: You may not use spam, false advertising, trademark infringement, or deceptive practices to promote The Laser Workshop. Violation will result in immediate termination and forfeiture of unpaid commissions.

Lead Intake & Service Listings

The Laser Workshop provides tools for users to list their services and receive project leads.

  • Lead Quality: We do not guarantee the quality, validity, or success of any leads generated through the platform.
  • Client Relationships: Any work performed for a client found through The Laser Workshop is a direct contract between you and that client. The Laser Workshop is not a party to these contracts and is not liable for payment disputes or project outcomes.
  • Professional Conduct: You agree to respond to leads professionally and deliver promised work. Repeated complaints may result in removal from the Maker Map.

Cancellation and Termination

  • Voluntary Cancellation: You are solely responsible for properly canceling your account. You can cancel your account at any time from your account settings. Upon cancellation, your content will be deleted within 60 days.
  • Subscription Cancellation: You can cancel your subscription anytime. You will retain access until the end of your current billing period. No refunds for partial months.
  • Termination for Abuse: We may terminate your account immediately if you abuse the Service (e.g. spamming, harassment, uploading malicious files, sharing hazardous settings without warnings).
  • Our Right to Terminate: We reserve the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time, with or without cause.
  • Effect of Termination: Upon termination, all licenses granted to you will cease, and you must stop using the Service.

Copyright and Content Ownership

  • The Company or its licensors own all right, title, and interest in and to the Services, including all intellectual property rights therein.
  • You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from the Company.
  • All content posted on the Services must comply with U.S. copyright law. We will respond to valid DMCA takedown notices.
  • User-generated content (settings, projects, etc.) remains owned by the user but is licensed to us for use on the platform.

Liability & Warranties

Disclaimer of Warranties:

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability:

  • You agree that the Company is not liable to you or to any third party for damages of any kind that result from the use of the Services, inability to access data, or unauthorized access of your data or account.
  • The Company is not liable for damages related to actions of any third party that uses the Services.
  • IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
  • Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website 30 days before the change takes effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

Governing Law & Disputes

  • These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law provisions.
  • Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.
  • You agree to waive any right to a jury trial or to participate in a class action lawsuit.
